TOWN OF WALLKILL, N.Y. --  A suspect in last weekend's shooting at the Galleria at Crystal Run has been arraigned after turning himself in.

This comes less than a day after police released surveillance video to the public that shows a man and woman with two children entering and walking through the mall.

'We have determined that the defendant was the individual who discharged a licensed handgun at the Galleria on November 26, resulting in the injuries to two individuals, including a 12-year-old boy and his mother," said Town of Wallkill Police Chief Robert Hertman.

Michael Perez-Rodriguez, 27, of Pennsylvania, pleaded not guilty to two counts of assault. Those charges come from the injuries to the mother and son. He has also been charged and pleaded not guilty to reckless endangerment for what a detective called "discharging a firearm aimlessly."

It's still unclear whether the shot was an accidental misfire.

"By the term accidental, it means that given the facts and circumstances, whatever happened, was completely unavoidable. I would be very hesistant to use that term in this particular case," said Orange County District Attorney David Hoovler.

Investigators say Perez-Rodriguez has no prior criminal record, and was not committing a crime by carrying his gun in the mall.

"The suspect in this case had a valid New York State carry permit issued in Sullivan County. Therefore, because a valid permit was issued by a judge in the state of New York, that individual was allowed to carry this gun," said Hoovler.

Perez-Rodriguez -- who appeared in court clean-shaven, while bearded in the video -- surrendered his passport, despite it being expired. He's expected to be back in court next week. He could face up to seven years in state prison for reckless endangerment, and up to a year for assault.
