The owners of a popular waterfront restaurant are being sued for failing to pay workers the city’s mandated living wage.

Six former employees have filed suit against William K’s for not paying them the $13.06 hourly rate mandated by Buffalo’s living wage requirement.

Molly and William Koessler were warned several times that they were legally obligated to pay their employees at least that rate per hour but, the lawsuit alleges, they never did.

When contacted for comment early Tuesday, the owners didn’t want to comment because they were not aware of the lawsuit.

Attorneys for the employees also say the Koesslers illegally reclassified the employees as salaried to avoid paying overtime. The attorneys also say the employees were made to work off the clock.

The living wage ordinance, in place since 1999, requires all establishments with city contracts to pay their employees a minimum of $13.06 per hour.

The city of Buffalo invested $900,000 in the facility, which opened as William K’s in December 2015, as a way to encourage people to visit the waterfront year-round.
