SYRACUSE, N.Y. -- A Rome farm worker detained by ICE remains in custody following a detention hearing in federal court. 

Marcial DeLeon Aguilar is charged with illegal re-entry into the country.

Aguilar was working on John Collins' dairy farm on Thomas Road in Rome last week when he was detained. 

They say Aguilar is a citizen of Guatemala and is illegally residing on Collin's farm on immigration violations. 

ICE has previously deported him three different times - most recently in January of 2014. 

He has criminal convictions for reckless aggravated assault in 2007 and illegal re-entry into the country in 2011 and 2014. 

In court Tuesday U.S. District Court Judge Andrew Baxter ruled that Aguilar was a flight risk. 

We spoke to Collins after the proceedings who says Aguilar is a hard working man just looking to support his wife and four children.  

"He's been here since September and he's never been late.  He's supposed to be there at 4:00, he's there at 3:55 every morning.  He's caught on quick to our routine. Just a good man," said Rome Dairy Farmer John Collins. 

If convicted, Aguilar could face two and a half to 10 years in prison. 

He will remain in detention until his preliminary hearing scheduled for federal court May 3rd.
