SYRACUSE, N.Y. -- Bail has been set at $1 million for the former DeWitt doctor accused of killing his wife.

Robert Neulander was back in court Monday, as he gets ready to go on trial for a second time for his wife's death in 2012.

The first conviction was thrown out because of juror misconduct.

Neulander's attorney requested he be freed while awaiting trial number two, arguing he should be allowed to spend time with family.

But the prosecution claimed he has the financial resources and money to flee the country, as well as dual citizenship in Israel.

"Sometimes when someone has large financial resources, it means they have the ability to flee. Here they are grossly overestimating his financial resources, which have been depleted because he went through a trial and an appeal. There have been some legal costs for sure,” said Kimberly Zimmer, defense attorney.

Ultimately, the judge set bail at $1 million and bond at $2 million.

Neulander also has to surrender his passport and have GPS tracking. If he does make bail, he would need written permission to leave Onondaga County.

He is due back in court in October.
