ROCHESTER, N.Y. -- Charges have been upgraded for the Rochester father accused of firing a bullet that killed his 2-year-old son. 

A grand jury has indicted 36-year-old Charles Timothy Phillips on charges of second-degree manslaughter and criminal possession of a weapon.

Zayden Phillips, 2, died at Strong Memorial Hospital after he was shot last month inside his Walnut Street home in Rochester.

The child was shot in the head and died from a brain injury.

Police searching the home found an illegal 9mm handgun in the home loaded with nine rounds.

Phillips was initially charged with assault and criminal possession of a weapon.

He previously served prison time for an attempted robbery conviction back in 2009.
