The case of Mary Yoder's death will go back in front of a grand jury in Oneida County after Kaitlyn Conley's manslaughter conviction in Yoder's poisoning death was overturned.
Oneida County District Attorney Todd Carville's office said late last week that, following a review of all evidence, it will present evidence to a grand jury "to determine what, if any, charges would be appropriate."
Conley was serving a 23-year prison sentence for first-degree manslaughter for the poisoning of Yoder, who was also her ex-boyfriend's mother, in 2015. Her appeal was granted on the grounds of ineffective assistance of counsel in late January after more than seven years in prison.
Carville was not the district attorney during Conley’s trials, and although he was working in the district attorney's office, he was not a part of the prosecution of the case.
"Until the Grand Jury has taken action, the Office of the District Attorney cannot ethically provide any further comment," read a statement from Carville's office.
