SAN MARCOS – A 23-year-old will spend the next seven years in prison after she was sentenced for a drunken driving crash that killed a man and his unborn child.

Shana Elliott pled guilty to two counts of intoxication manslaughter after consuming alcohol before a crash in 2016 that killed Fabian Guerrero, along with his unborn child, and injured his pregnant wife, Kristian Guerrero.

Testimony from the surviving Guerrero detailed the moment Elliott veered into oncoming traffic and hit them head-on. While at the hospital, Guerrero received the news that her husband and baby did not make it.

Elliott’s defense attorney argued that she was a young college student who made a bad decision to get behind the wheel that night.

Judge Jack Robinson sentenced Elliot to serve two prison sentences of seven years consecutively before 10 years on probation.

“This is a tragic case whose only good outcome can be found in the hope that the next Shana Elliott will choose not to drink and drive, saving the lives of the next Guerrero family,” said Hays County Criminal Attorney Wes Mau.
