AUSTIN, Texas – Judge Tim Sulak has denied the temporary injunction brought by the Texas Public Policy Foundation against Austin's Paid Sick Leave Ordinance.

The lawsuit attempted to stop the implementation of paid sick leave in Austin.

In February, the Austin City Council passed a policy mandating paid sick time for all employees. The City became the first in the South to pass an ordinance like this.

According to the TPPF, the lawsuit filed in April represents local businesses who hope to keep the ordinance from taking effect on Oct. 1.

Under the policy, companies have to set aside one hour of paid sick time for every 30 hours an employee works. Under the paid sick time umbrella, employees can take off work for personal health, family or anyone else equivalent to a family member.

The director of TPPF’s Center for the American Future, Robert Henneke, said the constitutional and legal claims in their suit need to be addressed before the policy officially begins.

The case will proceed to trial. At this time, the ordinance is still set to take effect Oct. 1.
