Three correction officers charged in connection with the beating death of Robert Brooks at Marcy Correctional Facility in December rejected plea deals Tuesday in the case.
Anthony Farina, Nicholas Kieffer and David Kingsley appeared in Oneida County Court, declining plea offers after one officer had already accepted a deal last week.
The officers charged had been granted extensions to decide on the offers. Farina, Kieffer and Kingsley are facing the highest charges of murder in the case.
Onondaga County District Attorney William Fitzpatrick has recommended to the judge no more than 18 years in prison for those who accept the plea deal. Farina and Kingsley were offered 18 years to life if they pleaded guilty to second-degree murder charges; Kieffer was offered 12 years in prison in exchange for a guilty plea to a gang assault charge.
The charges stem from an incident at Marcy Correctional caught on body-worn cameras, triggering widespread outrage and calls for justice. Body camera footage released by the New York attorney general’s office shows correctional officers hitting Brooks while he was restrained at the prison on Dec. 9. He died the next day at a hospital in Utica.
The three officers who appeared in court Tuesday will make their next court appearances June 3. They face sentences of 25 years to life in prison if convicted on the murder charges.
Last Monday, Christopher Walrath entered a guilty plea to a first-degree manslaughter charge before Judge Robert Bauer; Walrath will be sentenced Aug. 4, and faces up to 15 years in state prison.
